What is a class action?
Companies who commit fraud and systemically violate the law are often not brought to justice. The fraud or illegality may go undetected especially when it involves small amounts of money taken from a large group of people. It is often uneconomical for a single person to bring one lawsuit. The potential recovery may be too small to warrant individual litigation in that the costs of litigation would exceed the amount of the recovery.

A class action lawsuit, sometimes referred to as a private attorney general's action, is one solution to that problem. The class action device allows an individual to represent a group of similarly situated individuals who have been harmed from a common business practice. Individuals with relatively small dollar claims or non-monetary harms can aggregate their claims and hold the corporation responsible for the wrongdoing. Only one person is needed to file a class action complaint on behalf of the group.
What class actions will the firm pursue?
The Firm's practice is not limited to a particular area of law or industry. We take on various types of class actions, depending on whether the claim is suitable for class action treatment or another form of group litigation. Examples of cases that may be suitable for class action treatment are cases arising out of false advertising and mislabeling, unfair and deceptive, and fraudulent business practices, violations of wage and hour laws, misclassification of independent contractors, and violations of privacy laws, such as the TCPA. These are just a few examples and whether a case deserves class action treatment depends on the facts of the case.
We will listen to your case and determine whether we believe it can be brought as a class action or if there is another effective avenue for relief. We take on cases that require extensive pre-suit investigation that are passed up by other class action firms. We are licensed to practice law in California and New York, but we will litigate in state and federal courts throughout the nation by associating with counsel in those jurisdictions. We fight aggressively but we also resolve cases where settlement is the best option.
